QUESTION
I do not think that the plaintiff's case has any merit. Why can't I just get it dismissed?
ANSWER
Unfortunately, it is often difficult to get a case dismissed short of trial, even if has very little merit. Under the Ohio Rules of Civil Procedure, any questions over whether there are genuine issues of material fact are to be decided in favor allowing an issue to be decided by a jury trial.
